TCPA Messaging Policy
Consent first
Text messaging can be regulated under the Telephone Consumer Protection Act (TCPA) and related rules. Pingsley is designed for consent-based messaging only.
Maintain consent
Use an appropriate consent flow and retain evidence of the permission you rely on. Do not treat a purchased list as consent.
Identify the sender
Messages should make the sender reasonably clear and should not mislead recipients about who is communicating.
Opt-out
Every message should include a clear opt-out path. STOP is the standard keyword in this product concept. In a live implementation, STOP requests should be processed automatically and become effective within 10 minutes.
No purchased lists or cold texting
Purchased lists, cold texting, spam, and impersonation are prohibited under the Acceptable Use Policy.
Operational responsibility
You are responsible for your campaigns, disclosures, consent records, timing, content, and compliance with applicable federal and state requirements.
Carrier practices
Delivery and filtering are controlled in part by carriers and messaging ecosystems. Pingsley does not promise 100% delivery.
Launch requirement
Before connecting a live SMS provider, obtain appropriate legal and compliance review for your use case, consent language, and operational procedures.
